Cluster Contracts and Commercial Manager

To minimize the risk of commercial exposure to the Cluster, O&M Companies and Project Companies (PCs) and by extension ACWA and their affiliates by providing the following:

  • Administration of the Project Agreements.
  • Review of all incoming correspondence from a commercial risk and contractual compliance perspective and advise the Project Team of the commercial aspects and drafting of appropriate responses.
  • Development of Contract Management processes and procedures specific for the project.
  • Development of the understanding of Contract Management within the Cluster team and Contract Management support to the Cluster and its respective PCs and O&M Companies as required.
  • Reviewing and actively contributing to the Risk Registers at Cluster level as well as the PCs and O&M Companies.
  • Attendance at meetings and preparation of MOM's as directed by the Cluster Head.
  • Oversight of the Cluster compliance with good practice and obligations under the governance obligations outside the remit of the Finance Department.
  • Understanding and dissemination of the scope and obligations of the Project Insurances to the PCs and O&M Companies. Support the PCs and O&M Companies in any insurance claims.

Responsibilities:

Understanding of Contractual Agreements

  • Purchase Agreements, O&M Agreements and associated documentations.
  • EPC Contracts
  • Other agreements (Land Lease Agreement, Electrical Connection Agreement, Water Connection Agreement, Usutruct Agreement, etc.)

Development of Contract Management (CM) Processes and Procedures

  • Using as a base the Contracts Management Tool Box implement a consistent and auditable approach by implementing procedures.

EPC Contract Management

  • Establish a list of Contractor's deliverables under the EPC Contract.
  • Proactively expedite the contractor's awareness and compliance with the contracts
  • Identify shortfalls and promote remedies
  • Manage the process for achieving PAC
  • Monitor and maintain records of the performance guarantees, insurances for which the contractor is responsible.
  • Endeavour to ensure the contractors compliance with the insurance obligations
  • Support Planning/Scheduling Manager to review Monthly Progress Reports and regular meeting MoM

Management of the PC's Client

  • Identify all the obligations for deliverables under the Purchase Agreement
  • Ensure compliance with time related notices.
  • Monitor all correspondence.
  • Liaise with insurers for notification of significant shipments and in the event of any claims for loss and/or damage under any of the insurances in place during the project construction.

Adhoc support to the management

  • Perform other related duties or assignments as directed.

QUALIFICATIONS, EXPERIENCE, & SKILLS:

Qualifications:

  • Ideally a member, or past member of a recognized professional body (MRICS, MCIOB, ACIAirb, AcIrIMEch, MICE, IStruchE etc.)
  • Qualifications above degree level from reputed university or professional body or qualified by experience with a progressive development to a senior CM role.
  • Strong background in the management of contracts and the understanding and working experience of English Law.
  • Recognised qualification in written and spoken English.
  • Excellent English business language skills both written and spoken.
  • 10-15 years' experience in the Power, utilities and industrial sector
  • Working internationally and in mixed nationality teams and contractors/subcontractors
  • Ability to complement the decision-making processes based on experience, current knowledge and strong development in the industry.
  • Working in multinational teams and support the development of team members.
  • Capable of understanding the requirements for planning, reporting and the requirements for delay analysis.
  • Letter writing skills related to contractual obligations.
  • Excellent analytical skills
  • Willingness to establish an understanding of latest technology and innovation
